Terms of Use

These terms set out the agreement between you and Omnif AI when you use our website and WhatsApp automation services. Please read them carefully — by using our services, you agree to them.

Omnif AI (“Omnif AI”, “we”, “us” or “our”) provides WhatsApp Business API, broadcast messaging and AI chatbot services to businesses in Qatar and the wider Gulf. These Terms of Use (“Terms”) govern your access to and use of our website (omnifai.qa) and our services.

By creating an account, booking a demo, or otherwise using our services, you (“you”, “your” or the “Customer”) confirm that you have read, understood and agree to be bound by these Terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind that company.

01  Acceptance of terms

These Terms form a legally binding agreement between you and Omnif AI. They apply together with any order form, plan description or written agreement you enter into with us. If there is a conflict, a signed agreement takes precedence over these Terms, which in turn take precedence over any other page on our website.

If you do not agree with these Terms, you must not use our website or services.

02  Definitions

  • “Services” means our WhatsApp Business Platform onboarding, AI chatbot, broadcast messaging, shared inbox, automations and any related features we make available to you.
  • “End User” means a person who communicates with you through a WhatsApp channel we operate on your behalf.
  • “Content” means messages, media, templates, catalog items and any other material submitted through the Services.
  • “Platform Providers” means Meta Platforms, Inc. and its affiliates that operate the WhatsApp Business Platform.

03  Our services

Omnif AI helps businesses automate customer conversations on WhatsApp through the official WhatsApp Business Platform. Depending on your plan, this may include chatbot setup and training, bulk and broadcast messaging, a multi-agent shared inbox, catalog and appointment features, automations and integrations.

We may add, change or remove features to improve the Services. We will not materially reduce the core functionality of a paid plan during your billing period without notice.

04  Eligibility & accounts

You must be at least 18 years old and operating a lawful business to use the Services. You are responsible for keeping your account credentials secure and for all activity that takes place under your account.

  • Provide accurate, current and complete information when you register or book a demo.
  • Keep your WhatsApp Business number, business details and payment information up to date.
  • Notify us promptly if you suspect any unauthorised use of your account.

05  Acceptable use

You agree to use the Services lawfully and responsibly. In particular, you must not:

  • Send spam, or message people who have not opted in to hear from you.
  • Send unlawful, fraudulent, misleading, defamatory, obscene or infringing content.
  • Breach WhatsApp’s Business Messaging Policy, Meta’s Commerce Policy, or any applicable law of the State of Qatar.
  • Attempt to reverse-engineer, disrupt, overload or gain unauthorised access to the Services.
  • Resell or provide the Services to a third party without our written consent.

You are solely responsible for obtaining valid consent from your End Users before messaging them, and for honouring opt-out requests such as “STOP”.

06  WhatsApp & Meta compliance

The Services rely on the WhatsApp Business Platform operated by the Platform Providers. Your use of WhatsApp through us is also subject to WhatsApp’s Business Messaging Policy and Meta’s terms. We may suspend or limit messaging that we reasonably believe breaches those policies, and we are not responsible for actions taken by the Platform Providers, including number bans, quality-rating changes or template rejections that result from your Content or messaging practices.

07  Plans, fees & billing

Paid plans are billed in Qatari Riyals (QAR) in advance on a monthly or annual basis, as shown on our Pricing page or your order form. Unless stated otherwise:

  • Fees are exclusive of any taxes or charges that may apply under Qatari law, which are your responsibility.
  • WhatsApp conversation charges set by the Platform Providers may apply in addition to your plan fee.
  • Plans renew automatically unless cancelled before the end of the current billing period.
  • Fees already paid are non-refundable except where required by law, and no refund is given for partial billing periods.

We may change our prices with reasonable prior notice; changes take effect from your next billing cycle.

08  Free plan & offers

We may offer a free plan or promotional pricing. Free and discounted plans are provided “as is”, may include usage limits (such as subscriber or team-member caps), and may be changed or withdrawn at any time. Introductory or discounted rates apply only for the stated period and terms and conditions apply.

09  Intellectual property

All rights in the Services, including our software, website, branding and documentation, belong to Omnif AI or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription, solely for your own business.

You retain all rights in your Content. You grant us a licence to host, process and transmit your Content only as needed to provide the Services and as described in our Privacy Policy.

10  Data & privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. You are responsible for ensuring you have a lawful basis to collect and share End User data with us, and for complying with Qatar’s Personal Data Privacy Protection Law (Law No. 13 of 2016) in respect of your own customers.

11  Third-party services

The Services may integrate with third-party tools such as Meta, Google Calendar, Zapier, Shopify and payment providers. Your use of those tools is governed by their own terms, and we are not responsible for third-party services, their availability, or any changes they make.

12  Availability & support

We work hard to keep the Services available, but we do not guarantee uninterrupted or error-free operation. The Services may be temporarily unavailable for maintenance, updates, or reasons outside our control, including issues with the Platform Providers. Support is provided according to your plan (for example, standard, on-call or priority support).

13  Suspension & termination

You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period. We may suspend or terminate your access if:

  • You breach these Terms or any acceptable-use or platform policy.
  • Payment is overdue, or your use poses a security or legal risk.
  • Required by a Platform Provider, regulator or applicable law.

On termination, your right to use the Services ends. We may delete your Content after a reasonable period, subject to any legal retention obligations.

14  Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose. We do not warrant that the Services will meet every requirement, produce any particular business result, or that AI-generated responses will always be accurate. You are responsible for reviewing automated messaging before relying on it.

15  Limitation of liability

To the fullest extent permitted by the laws of the State of Qatar, Omnif AI will not be liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data or goodwill, arising from your use of the Services. Our total liability for any claim under these Terms will not exceed the fees you paid to us for the Services in the three (3) months before the event giving rise to the claim.

16  Indemnity

You agree to indemnify and hold Omnif AI harmless from any claims, damages, losses or costs arising from your Content, your messaging practices, your breach of these Terms, or your failure to obtain valid consent from your End Users.

17  Governing law & jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Qatar. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably will be subject to the exclusive jurisdiction of the competent courts of Doha, Qatar.

18  Changes to these terms

We may update these Terms from time to time to reflect changes in our Services or the law. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you. Your continued use of the Services after changes take effect means you accept the updated Terms.
